A Stepparent Adoption is when one of the biological parents has remarried and the new spouse wishes to adopt the child from a previous relationship.
In a Stepparent Adoption first try to obtain the consent of the biological parents this will facilitate the adoption process. If there is consent an Adoption Agreement will be signed by the parties. If consent cannot be obtained you will need to file an action to have the parental rights terminated of the Biological parent in order to free the child for adoption. The termination of parental rights must take place first. At the hearing the parents who rights are being terminated may have representation. An attorney for the minor child may also be requested and one may be appointed.
If you are trying to free the child from the Mother or from a presumed father, you will need to file an Abandonment Petition in order to free the child from Parental custody.
The child will be interviewed and a home visit will be conducted before the court hearing. Attendance at the court hearing is required of the Stepparent, the biological/custodial parent and the child to be adopted. If the child is 12 years of age or older the child will need to agree to the adoption. The adoption will be granted if the court finds that the adoption is in the child’s best interest.
If you do not know the whereabouts of the biological parent you may have to give notice by publication in order for the adoption hearing to take place.
At the hearing once approved you will obtain certified copies of the Order of Adoption.
The order will be used to obtain a new birth certificate for the adopted child reflecting the new parents names.
