California law requires that one of the parties be a resident of the State of California for 6-months and of the county where they will file for divorce for 3-months. Further, there is a 6-month and 1 day waiting period before the divorce is final.
If the parties concur on all of the matters involving their divorce, a stipulation “agreement” is drawn up and filed with the court a court appearance may not be necessary depending on the facts of your case.
However, if child custody, child support; spousal support issues need to be addressed, temporary orders will need to be agreed upon or if no agreement a Request For Order will be filed on your behalf. At the hearing, if no unforeseen issues arise the judge will make temporary orders. These orders can then be adopted into the final Judgment and made permanent. (Please note: “permanent” does not mean it is etched in stone. Orders can always be modified if there is a substantial change in circumstances. A substantial change may include loss of employment, move-away, change in marital status, job promotion…etc.)
A trial will be held before a judge if the division of assets, child custody, child support; spousal support “alimony” are not agreed on.
