The Domestic Partnership Dissolution Attorney in California reported: the Prop 8 and Doma ruling was given on June 26, 2013; the Supreme Court ruled that a portion of the Defense of Marriage Act was unconstitutional. In addition, the Supreme Court is upholding the lower court’s ruling on same sex marriage, signifying that same sex couples will once again be able to marry. Some estimate that same sex couples may be able to get married as soon as the end of July.

The Defense of Marriage Act that was found unconstitutional was that Doma denies federal benefits to those in a same sex relationship. With this part of the Defense of Marriage Act being found unconstitutional those same sex couples who have legally married in states that allow same sex marriage will now receive all federal benefits. Moreover, the Supreme Court ruled that those individuals who brought the case forward did not have the appropriate jurisdiction do so, and therefore, dismissed Prop 8.

Furthermore, the decisions made by the Supreme Court are a huge victory. Same sex couples should be able to marry sometime soon depending on the duration of time it takes to get all of the legal aspects squared away.
